A charge of discrimination is a serious issue that can be filed against any organization. A signed statement states that an organization is entitled to employment discrimination.

However, many employees face discrimination, and with the help of Law Offices of Usmaan Sleemi, the victim employee may readily get justice. The process is long, but you must be patient and gather all information against this discrimination.

    Filing an Employment Discrimination

We shared some crucial steps to file employment discrimination.

    • Time Limits for Filing a Charge

The time limit for filing a case is fundamental to getting justice. Another significant thing is that where the discrimination occurred can determine the charge you must file.

The deadline for filing is 180 calendar days, but it is increased to 300 if a state or local agency suppresses a state or local law that similarly inhibits employment discrimination. The rules and regulations for age discrimination charges are slightly different. In the case of age discrimination, the filing date is extended up to 300 days if a state authority has suppressed a state law inhibiting age discrimination in employment.

    • Use the EEOC Public Portal to Submit an Inquiry, Schedule an Appointment, and File a Charge

A charge of discrimination can be completed through the EEOC’s online portal. After submitting the charge, the EEOC members organize an interview. Here, you can face some questions, and it is an honorable organization to handle this kind of charge regarding employment discrimination.

    • The Experience at an EEOC Office

The victim or someone who has filed an online form of employment discrimination at the EEOC offices can have a chance to discuss their concerns with an EEOC staff member in an interview. It is the best way to learn and assess how to address their concerns about employment discrimination.

Further, you can decide whether to file a case or not. Even if the office has cleared all the employment law regulations, the final call is yours.

An EEOC team member will create a charge using the information you provided. Later, you can review and sign online to log into your account.

Moreover, you would have to file a charge of employment discrimination at the EEOC office nearest your residence or any of EEOC’s field offices. Then, as per your charges, where discrimination happened has to be adequately investigated.

It adds more value if you carry papers that will help the EEOC’s staff. Here are some examples: If you are fired because of performance, you can bring the letter that tells you were terminated. Also, you can get language transcription or any assistance.

    • Over Telephone

If you avoid the expenses, EEOC’s online platform has a telephone number. You can connect over the telephone to discuss the case further. The representative will ask you essential details about the case, and the staff member can teach you how to file a case

    • In a State or Any Local Employment Agency

Many states and residents have employment agencies that impose laws inhibiting employment discrimination. After contacting the EEOC, they refer to these agencies for accurate and truthful employment practices.

As per the agreements, if you file a charge with the EEOC or FEPA, the charge will automatically be filed with the other agency. This process is called dual filing.

    Conclusion

Filing a case of employment discrimination is easy. However, the EEOC is mainly unable to investigate a charge of discrimination promptly.

Even if the place of investigation is conducted, the EEOC doesn’t frequently make cause determinations and rarely files lawsuits against employment discrimination victims.

However, do not worry; file a case against employment discrimination. Justice knocks at your door.
